An act to add Sections 40429 and 40472 to the Health and Safety Code, relating to air pollution.

SB 1203, as amended, Hayden. Air pollution: airport expansion.

Existing law, the Lewis-Presley Air Quality Management Act, establishes the South Coast Air Quality Management District with prescribed powers and duties pertaining to air pollution control.

This bill would define airport expansion. The bill would also require the chairperson of the south coast district board to convene an advisory committee on the air quality impacts from the proposed airport expansion, thereby imposing a state-mandated local program.

The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.

This bill would provide that no reimbursement is required by this act for a specified reason.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

SECTION 1. Section 40429 is added to the Health and Safety Code, to read:

40429. (a) The chairperson of the south coast district board shall convene an advisory committee on the air quality impacts from the proposed airport expansion. The advisory committee shall consist of at least 15 members who shall include, but not be limited to, representatives of local chambers of commerce, local homeowners' associations, community based organizations, clean air and coastal advocates, environmental organizations, labor organizations, and local and state officials. Members of the advisory committee, to the extent feasible, shall reside in areas impacted by the airport expansion. The advisory committee shall be appointed not later than January 15, 1999, and shall terminate upon completion of its duties as outlined in subdivisions (b), (c), and (d).

(b) The advisory committee shall develop a program to heighten public awareness of the air quality impacts of the airport expansion, study the cumulative impacts of the expansion, and seek ways to enhance the air quality goals of the district, while taking into account local economic and quality of life needs.

(c) The advisory committee shall make findings and recommendations to the south coast district board on how to reduce negative air quality impacts from the proposed expansion. The findings and recommendations shall be considered by the South Coast district board and forwarded to the United States Environmental Protection Agency. The advisory committee shall also provide input to the south coast district board on fulfilling its responsibilities related to the airport expansion as a responsible agency under Division 13 (commencing with Section 21000) of the Public Resources Code.

(d) The advisory committee shall hold public forums and invite broad-based citizen, neighborhood, and expert input.

SEC. 2. Section 40472 is added to the Health and Safety Code, to read:

40472. As used in Section 40429, "airport expansion" includes any of the following:

(a) The acquisition of clear zones or of any interest in land for the purposes of subdivision (b), (c), (d), or (e).

(b) The construction of a new runway.

(c) The extension or realignment of an existing runway.

(d) Any other expansion of the airport's physical facilities for the purposes of accomplishing, or that are related to, a purpose specified in subdivision (b) or (c).

(e) Any capital improvement that expands the passenger service level capacity of the airport.

SEC. 3. No reimbursement is required by this act pursuant to Section 6 of Article XIIIB of the California Constitution because a local agency or school district has the authority to levy service charges, fees, or assessments sufficient to pay for the program or level of service mandated by this act, within the meaning of Section 17556 of the Government Code.

Notwithstanding Section 17580 of the Government Code, unless otherwise specified, the provisions of this act shall become operative on the same date that the act takes effect pursuant to the California Constitution.
